Terms of Use

Version 1.0 — Effective 9 November 2025

These terms govern your use of the OpenAssistant iOS application, support website, and associated documentation. By downloading or using OpenAssistant you agree to this agreement.

1. Eligibility & Acceptable Use

  • You must be at least 13 years old or the minimum age required in your jurisdiction to create an OpenAI developer account.
  • You are responsible for safeguarding your OpenAI API key and ensuring it is authorized for the usage you initiate.
  • You agree not to use OpenAssistant to violate any law, intellectual property rights, privacy rights, or OpenAI policy.

2. License

OpenAssistant is provided under a limited, revocable, non-transferable license for personal or organizational use. The source code is available under the repository's open-source license. Nothing herein grants you rights to use the OpenAI trademarks or any third-party content accessed via the app.

3. API Usage & Billing

  • You supply your own OpenAI API key; usage charges accrue directly with OpenAI.
  • I do not control pricing, rate limits, or billing disputes with OpenAI.
  • You are solely responsible for monitoring usage to avoid unexpected charges.

4. Data & Privacy

My Privacy Policy describes how I process information. By using the app you acknowledge that prompts, files, and responses are transmitted to OpenAI for processing under their terms. I do not host or store this content on my servers.

5. Support Commitments

  • I provide email-based support via support@fascinaiting.me.
  • Initial responses are issued within two business days; complex issues may take up to seven business days to resolve.
  • I may request diagnostic logs or screen recordings to troubleshoot issues; providing them is optional.

6. Updates & Availability

OpenAssistant may receive updates that add, modify, or remove features. I strive for high availability but do not guarantee uninterrupted service, especially during upstream OpenAI outages or App Store maintenance.

7. Disclaimer & Limitation of Liability

  • OpenAssistant is provided "as is" without warranties of any kind, express or implied.
  • To the maximum extent permitted by law, I am not liable for indirect, incidental, consequential, or punitive damages, lost profits, or loss of data.
  • In jurisdictions where limitations on liability are restricted, my liability is capped at USD $50.

8. Termination

You may stop using the app at any time. I may suspend or terminate your access if you violate these terms or use the app in a way that creates risk for me or other users. Upon termination you must cease using the app and delete local copies.

9. Governing Law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in San Francisco County, California.
